Description

Tax Audits of Private Wealth: Detecting, Anticipating and Limiting Risks

Prepare a client's wealth documentation long before a tax authority takes an interest in their filings

  • 1 day — 7 h
  • In-person or virtual
  • Intermediate
  • Up to 6 participants

An adjustment affecting private wealth is rarely dealt with successfully under the pressure of an audit: the outcome is decided upstream, in the consistency of filings, the traceability of gifts and transfers, and the substantiation of valuations. Advisers are often called in once the assessment notice has arrived, when the room for manoeuvre has already narrowed.

This one-day programme follows the sequence of a review targeting private wealth: source of funds, assets held abroad, valuation of property and unlisted shares, and intergenerational transfers. It shows how to secure files in advance, respond to requests from the reviewing officer and carry the discussion through to formal dispute where necessary.

The programme addresses both UAE requirements and the foreign tax authorities that frequently examine internationally mobile clients.

Learning objectives

  • Identify the elements of private wealth that attract scrutiny from tax authorities
  • Reconstruct the source of funds and the traceability of transfers and gifts
  • Substantiate the valuation of real estate assets and unlisted shares
  • Respond to an information request and then to a proposed adjustment
  • Choose between negotiated settlement and formal dispute proceedings

What makes this programme different

The course follows an audit document by document from the initial request onwards
Files brought by participants form the basis of the substantiation exercises
A response template to a proposed adjustment is drafted during the session

  • Documents to produce and documents never to improvise
  • Managing written exchanges and face-to-face meetings
  • Voluntary correction options available during the procedure

3Outcomes and Disputes

Negotiating the adjustment and then contesting it

  • Analysis of a proposed adjustment and of the reasoning behind it
  • Substantive arguments available on characterisation and valuation
