Description

Mortgage Lending: Securing the Legal Framework, Disclosure and Contracting

Build mortgage files in which every step withstands a challenge from the borrower

  • 1 day — 7 h
  • In-person or virtual
  • Intermediate
  • Up to 6 participants

A mortgage file is rarely challenged on the rate: it is challenged on pre-contractual disclosure, the affordability assessment, the duty to warn or the borrower protection insurance. Relationship managers apply internal procedures without always knowing the rule behind them or the exposure this creates for the institution.

This one-day programme covers the full mortgage journey: pre-contractual disclosure and the offer, affordability assessment, security, borrower protection insurance, then the life of the facility including early settlement and payment defaults. Each step is examined from the standpoint of the lender's obligations and the evidence it must be able to produce.

Learning objectives

  • Comply with pre-contractual disclosure obligations towards the borrower
  • Assess affordability and formalise the duty to warn
  • Secure the content of the loan offer and its acceptance
  • Select security appropriate to the file and put it in place
  • Handle events during the life of the facility and default situations

What makes this programme different

Each step of the journey is linked to the document that evidences the obligation met
The most frequent disputes are traced back to the initial customer complaint
Files brought by participants are used as the basis for the exercises
