Description
Consumer Finance: Contracting, Disclosure and Dispute Prevention
Distribute consumer finance products while keeping evidence of every disclosure obligation
- 1 day — 7 h
- In-person or virtual
- Intermediate
- Up to 6 participants
Consumer finance is sold quickly and increasingly at a distance: purchase-linked finance signed at the point of sale, revolving facilities, debt consolidation. The speed of the journey sits uneasily with the disclosure and explanation duties borne by the lender and by the intermediary, and disputes almost always arise from that gap.
This one-day programme addresses the contractual features specific to consumer finance as opposed to home finance: the Key Facts Statement, suitable explanations, affordability and creditworthiness checks, the cooling-off period and the fate of purchase-linked agreements. It also covers revolving credit facilities and the correct conduct when a customer falls into financial difficulty.
Learning objectives
- Define which transactions fall within the scope of consumer finance
- Deliver pre-contractual information and provide the explanations due to the customer
- Assess the borrower's affordability and retain the supporting evidence
- Apply the cooling-off period and the rules governing purchase-linked finance
- Handle arrears and cases of customer over-indebtedness
