A declined cover, an incomplete risk disclosure, a termination notified incorrectly: insurance difficulties almost always stem from a legal mechanism applied poorly or too late. Colleagues coming from claims handling or sales often discover this while managing a disputed file.

Two days to set out the framework of the insurance contract: its formation and the effects of risk disclosure, its life and the conditions for amending it, then the handling of a claim from notification through to indemnification. The notions of cover, exclusion and recourse are worked through on real handling files.

2Cover, Exclusions and the Life of the Policy

Reading the policy as it will be read in a dispute

  • Distinguish general conditions, particular conditions and schedules
  • Position cover, formal exclusions and forfeiture of rights
  • Handle an increase or reduction of the risk during the policy period
  • Apply the rules on premium payment, suspension and termination

3Claims and Indemnification

From notification to the insurer's position

  • Organise claim notification and file investigation
  • Position the role of the loss adjuster and the challenging of their findings
  • Apply loss assessment rules and the limits of cover
  • Draft a reasoned coverage position and notify a declinature

4Recourse, Stakeholders and Disputes

After settlement and around the policy

  • Exercise subrogation and recourse against the liable third party
  • Position intermediaries and their obligations towards the client
