Description
Permit Litigation for Regulated Industrial Facilities: Anticipating Challenges, Defending and Remedying
Master the interaction between challenges to a building permit and challenges to an industrial operating permit
- 1 day — 7 h
- In-person or virtual
- Intermediate
- Up to 6 participants
An industrial project relies on two separate authorisations and therefore on two distinct dispute channels. The building permit is reviewed against its own admissibility rules and its own review body. The operating permit falls under a different authority with different powers. The time limits do not coincide. A flawed defence strategy can cost months when the defect could have been remedied.
One day, in-person or virtual, dedicated to this interaction. You identify who may challenge what and within which time limits. You distinguish a review limited to the legality of the decision from a review extending to the substance of the authorisation. You build a prioritised defence and assess the remediation routes available while proceedings are ongoing.
Learning objectives
- Identify challengeable decisions and the admissibility conditions applicable to appeals
- Distinguish the scope of review depending on whether the building permit or the operating permit is at stake
- Build a defence strategy matched to the grounds raised
- Assess remediation options available while proceedings are ongoing
- Anticipate disputes from the moment authorisation files are prepared
