Description

Distressed Companies: Detecting Signals, Positioning Proceedings and Taking Action

Understand what becomes of a bank claim when a corporate client enters insolvency or restructuring proceedings

  • 2 days — 14 h
  • In-person or virtual
  • Intermediate
  • Up to 6 participants

Relationship managers often discover a client's difficulties far too late. Payment incidents accumulate, the volume of flows entrusted to the bank declines, and the request for additional facilities arrives once the situation is already compromised. When proceedings open, the right reflexes are missing on filing the claim and on the fate of the security taken.

These two days provide the necessary reference points. Participants learn to read the signals of deterioration, to position amicable and formal insolvency proceedings and the role of the bodies involved, to file and defend a claim, and then to assess the treatment of securities and the situations that expose the lender to liability.

Learning objectives

  • Identify signals of deterioration in a client's accounts and banking flows
  • Distinguish amicable arrangements from formal insolvency proceedings
  • Position the role of the bodies involved and the sequence of the stages
  • Dile and defend a bank claim in the expected form
  • Assess the treatment of securities and outstanding commitments
  • Identify situations that expose the lender to liability

What makes this programme different

Deteriorating client files are analysed through to the institution's decision
A claim filing is drafted and then discussed line by line
High-risk situations for the bank are rehearsed from realistic cases
