Description
Maintenance and Subcontracting Contracts: Drafting, Negotiating and Managing
Secure your maintenance contracts and retain control over service providers throughout operations
- 2 days — 14 h
- In-person or virtual
- Intermediate
- Up to 6 participants
A poorly drafted maintenance contract is paid for over many years: a vague scope of work, response-time commitments with no consequences, spare parts invoiced as extras and a provider who cannot be objectively assessed. When service quality declines, the client organisation discovers it has neither the contractual levers nor the indicators needed to react.
Two days devoted to the contract itself: selecting the appropriate form of commitment, writing verifiable performance requirements, setting out penalties and exit clauses, then organising provider oversight during operations. This session complements the work of drafting the technical scope of work.
Learning objectives
- Select the contract form suited to the maintenance requirement
- Draft verifiable performance commitments
- Define pricing and price revision arrangements
- Frame the provider's on-site safety obligations
- Organise performance reviews and contract follow-up decisions
